Kratom’s legal status varies by country and, in the United States, by state. This page summarizes what we currently know — but laws change, sometimes quickly, so we recommend verifying your local regulations independently before ordering. Where Kratom Is Legal (Current Status)
United States: Legal in most states. Currently restricted or prohibited in Alabama, Arkansas, Connecticut, Indiana, Kansas, Louisiana, North Dakota, Tennessee, Vermont, Wisconsin, and Washington D.C. — these are automatically excluded at checkout. California is also excluded at this time pending further legal confirmation.
Netherlands: Legal. Kratom is not a controlled substance and is sold openly.
Germany: Legal for non-consumption purposes. Our products are labeled “not for human consumption,” which aligns with the permitted sale of kratom as a botanical specimen.
Czech Republic: Legal, regulated under a dedicated category for psychomodulatory substances since January 2025.
Spain: Legal.

Why Your Order Might Be Held by Customs
While uncommon for compliant orders, shipments can occasionally be held at customs. Common reasons include kratom being restricted in the destination jurisdiction, incomplete import documentation, the importer being on a customs watch list, unpaid duties or taxes (not applicable to DDP orders, where duties are already included), contamination findings during inspection, or demurrage fees at the port or airport.

Borneohale operates under PT Kreasi Alam Borneo, a registered kratom exporter based in Kalimantan, Indonesia.
Registered Exporter (ETPK) — official registration as a kratom producer-exporter, renewed every three years.
Export Approval (PE) — a valid export permit issued every six months, specifying approved destination countries.
Laporan Surveyor (LS) — independent lab verification (Sucofindo) confirming shipments meet Indonesia’s legal mitragynine threshold, included for all shipments 500 kg and above. See Shipping & Delivery for details.
PEKRINDO Membership — Borneohale is a registered member of Indonesia’s national kratom industry association.
